Jackpot Rules

A legal resident of one of the fifty (50) United States or the District of Columbia and 13 years of age or older on the date of entry (unless you are a resident of Maine, in which case you must be 18 years of age or older at entry);
OR meet the following qualifications:

a. A legal resident of Canada (excluding Quebec); OR
b. A legal resident of the United Kingdom (excluding Northern Ireland); OR
c. A legal resident of Australia

The age of majority in your jurisdiction on the date of entry.

Varolo will use reasonable methods to identify entries that are not eligible, and may either attempt to notify such ineligible entrants or ignore their entries.

Employees of Varolo (“Sponsor”), its respective parents, subsidiaries, affiliates, advertising and promotion agencies and their family/household members (defined as parents, spouse, children, siblings, grandparents) are not eligible to enter. Void elsewhere and where prohibited, taxed, or restricted by law.

The Sweepstakes begins (“Sweepstakes Start”) when notice of the Sweepstakes is published on www.varolo.com/sweepstakes and closes (“Sweepstakes End”) at the deadline shown on that page. The time between the Sweepstakes Start and Sweepstakes End is the Sweepstakes Period.

There are two ways to enter the Sweepstakes:

• Method #1: For every completed video that is properly viewed during the Sweepstakes Period, you will automatically receive an entry into the Sweepstakes.
• Method #2: You may enter by completing an online entry form located at www.varolo.com/sweepstakes. All online entries require a valid email address and a currently valid Varolo account (which is free to obtain). You may obtain one entry into each Sweepstakes with this alternative method.

No automated entry devices and/or programs are permitted. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Proof of submission will not be deemed to be proof of receipt by Sponsor.

Sponsor shall draw the winner from eligible entries received during the Sweepstakes Period, within seventy-two (72) hours after the Sweepstakes End. Sponsor’s decisions are final and binding in all matters relating to the Sweepstakes. Odds of winning will depend upon the number of eligible entries received. Potential winner(s) will be notified by e- mail or mail within five (5) business days after the drawing. Each entrant selected as a potential winner must comply with all terms and conditions set forth in these Official Rules, and winning is contingent upon fulfilling all such requirements.

Sponsor reserves the right to verify eligibility qualifications of any winner. If a Canadian resident wins a prize, that person must also answer correctly within a 5 minute time period a mathematical skill-testing question without the benefit of any human, mechanical or electronic calculating devices before the prize will be awarded. It is the sole responsibility of the entrant to notify the Sponsor in writing if the entrant changes his or her email address or other contact information.

The prize amount for the Sweepstakes will be posted on the Varolo site at www.varolo.com/sweepstakes. The prize amount may depend upon the number of entries received, but in no event shall the prize amount be greater than $5000 (due to compliance with applicable laws regarding Sweepstakes).

Sponsor will issue all prize awards via PayPal. Sponsor makes no warranties with regard to prizes. Prizes are not transferable. No substitutions of prize allowed by winner(s), but Sponsor reserves the right to substitute a prize of equal or greater value. All taxes, fees and surcharges on prizes, whether federal, state, local, provincial or otherwise, are the sole responsibility of the winner.

The winner will be required to execute an Affidavit of Eligibility, a Liability Release and where lawful, a Publicity Release within [14] calendar days of notification. If winner is a minor in his or her jurisdiction, the prize will be awarded to minor’s parent or legal guardian, if valid, and they must sign and return all required documents.

If the winner cannot be contacted within three calendar days of the first notification attempt by Varolo, if the prize or prize notification is returned as undeliverable, if winner rejects his/ her prize or in the event of noncompliance with these Sweepstakes rules and requirements, such prize will be forfeited and an alternate winner will be selected from the remaining eligible entries. Upon prize forfeiture, no compensation will be given. Limit one prize per person or household. Sponsor will have right to photograph the winner and use the photograph in certain marketing activities. Entry constitutes permission to winner’s name, picture, likeness, and general residence location (e.g. City) for purposes of trade, publicity or promotion for no additional compensation except where prohibited by law.

All entries become the sole property of Sponsor. In the event of a dispute, entries will be deemed made by the authorized account holder at the time of entry. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. If the Sweepstakes is compromised by a virus, bugs, non-authorized human intervention, or other causes beyond the control of Sponsor, which corrupt or impair the administration, security, fairness or proper play of the sweepstakes, Sponsor reserves the right, in its sole discretion, to suspend or terminate the Sweepstakes. If the Sweepstakes is terminated prior to the stated expiration date, notice will be posted at the Varolo.com website. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor due to technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials related to the Sweepstakes. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that the entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.

Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. Please review Sponsor’s privacy policy at http://www.varolo.com/ privacy.php . By participating in the Sweepstakes, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.

By participating, entrants and winner(s) agree to release and hold harmless Sponsor, and any respective parent companies, subsidiaries, affiliates, advertising and pro-motions agencies, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Sweepstakes, or possession, acceptance and/ or use or misuse of prize or participation in any Sweepstakes-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsors are not responsible if Sweep-stakes cannot take place or if prizes cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.

Except where prohibited, each entrant agrees:

• (1) Any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Salt Lake County, Utah, United States of America;
• (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event shall it include attorneys’ fees;
• (3) no punitive, incidental, special, consequential, or other damages, including without limitation lost profits, may be awarded (collectively, “Special Damages”); and
• (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. Utah State law, without reference to Utah’s choice of law rules, governs the Sweepstakes and all aspects related thereto.

To obtain a list of winners, please send a self-addressed envelope, with appropriate return postage, to Marketing Director, Online Fundraising and Promotion, Varolo, at the address listed below for the Sponsor. Within 6 weeks of the conclusion of a Drawing, Varolo will provide the name of the winner of the Sweepstakes, which will include the first initial, last name, and general listed geographical location (city/state; province; etc.) for each winner, along with the prize amount. Varolo may also elect to post such information online at the Varolo.com website.
